Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") form a legally binding agreement between you and Movers ("we," "us," or "our"). By accessing or using the Movers mobile application, website at getmovers.app, or any related services (collectively, the "Service"), you agree to be bound by these Terms and our Privacy Policy.

If you are using the Service on behalf of a business or entity, you represent that you have authority to bind that entity to these Terms.

2. Description of Service

Movers is a mobile application that aggregates and displays pre-market stock activity, volume data, and financial news headlines. The Service is provided for informational purposes only. We are not a registered investment adviser, broker-dealer, or financial institution. See our full financial disclaimer.

3. Subscription and Billing

Free Tier

A limited free tier is available with access to a subset of features. The specific features available on the free tier may change at our discretion with reasonable advance notice.

Subscription Billing

Subscriptions are billed monthly in advance through your Apple App Store or Google Play account. Your subscription automatically renews at the end of each billing period unless cancelled at least 24 hours before renewal. The renewal charge is processed within 24 hours of the end of the current period.

Price Changes

We may change subscription pricing at any time. We will provide at least 30 days' notice of any price increase through in-app notification or email. Price changes take effect at your next renewal date after the notice period. Continued use of the Service after the price change constitutes acceptance of the new price.

Taxes

All prices are exclusive of applicable taxes. Taxes are calculated and added at checkout based on your billing location and are collected by Apple or Google on our behalf.

4. Cancellation Policy

You may cancel your subscription at any time through your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period — you retain access to Pro features until then.

• iOS: Settings → Apple ID → Subscriptions → Movers → Cancel
• Android: Google Play → Subscriptions → Movers → Cancel

We do not offer refunds for partial billing periods except where required by applicable law (such as EU consumer regulations). If you believe you are entitled to a refund, please contact Apple or Google directly as they process all payments.

5. No Investment Advice

You acknowledge that all investment decisions are made at your own risk. Past price movements and volume patterns are not predictive of future results. We strongly recommend consulting a licensed financial adviser before making investment decisions.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulations
• Scrape, extract, or systematically download data from the Service
• Reverse engineer, decompile, or attempt to extract the source code of the app
• Use the Service to transmit spam, malware, or harmful content
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Resell or sublicense access to the Service or any data obtained from it
• Use the Service in any way that could damage, disable, or impair it

7. Intellectual Property

All content, features, and functionality of the Service — including but not limited to the app design, code, branding, and text — are owned by Movers and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes during your subscription.

Market data is sourced from Polygon.io and Marketaux under separate license agreements. That data remains the property of those providers and may not be extracted, redistributed, or used outside the app.

8. Data Accuracy and Availability

Financial data is provided by third-party sources (Polygon.io, Marketaux) and may contain errors, delays, or omissions. We do not guarantee the accuracy, completeness, or timeliness of any data displayed in the app. Market data may be delayed by up to 15 minutes unless otherwise stated.

We do not guarantee uninterrupted availability of the Service. We may perform scheduled or emergency maintenance that results in temporary unavailability. We will provide advance notice of planned outages where feasible.

9. Limitation of Liability

Our total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50 USD, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR CONTINUOUSLY AVAILABLE.

11. Account Termination

Termination by You

You may close your account at any time through Account → Settings → Delete Account in the app, or by emailing hello@getmovers.app. Upon deletion, your personal data is removed within 30 days per our Privacy Policy. Active subscriptions must be cancelled separately through the App Store or Google Play.

Termination by Us

We may suspend or terminate your account immediately, without notice, if you:

• Violate these Terms or our Acceptable Use policy
• Engage in fraud or abuse of the Service
• Attempt to circumvent subscription payments
• Take any action that endangers the security or stability of the Service

If we terminate your account without cause, we will provide a pro-rated refund for the unused portion of your current billing period.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be addressed through informal negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, conducted in English. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via in-app notification or email at least 14 days before taking effect. The updated Terms will be posted at getmovers.app/terms. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

14. Miscellaneous

Entire Agreement. These Terms, together with the Privacy Policy and Financial Disclaimer, constitute the entire agreement between you and Movers regarding the Service.

Severability. If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.

Waiver. Our failure to enforce any right or provision does not constitute a waiver of that right.

Assignment. You may not assign your rights under these Terms without our written consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.
